New Jersey divorce proceedings operate as is an "equitable distribution" state, any marital property will be judged upon and shall be divided in an equitable fashion. However this does not necessarily mean equal, but rather what the court deem fir on a case by case basis. The court will always allow for and encourage divorcing parties to make attempts on reaching a settlement concerning their property and debt issues. If this cannot be done the courts shall determine a property award. In each property distribution case the courts shall determine findings of fact that are based on all relevant issues concerning asset eligibility, value, and the equal distribution of the determined assets.
