In order to legally file for divorce in the state of Georgia there are residency requirements that must be met for the courts to proceed with the case. A Georgia divorce court will grant a divorce to a person who has legally been resident of the state for at least six months prior to the filing of the petition for divorce. If a either spouse has served n any part of the military and has been stationed in Georgia for at least a year, they may file for divorce under Georgia divorce law as a legal resident of the state of Georgia. If the minimum residency requirements are not met Georgia divorce courts can throw out the case.
