Alabama Divorce Laws | Alimony


Alabama divorce law states that the awarding of alimony is determined by the need of the spouse requesting the alimony and the ability of the other spouse to pay.So too is the amount that is agreed upon to be paid by the spouse in question at the time of the filing. If fault is a factor in the divorce, the judge has the right to make an allowance to either spouse out of the estate of either spouse, or not make an allowance depending on the circumstances of the case may justify. However, any property acquired prior to the marriage of the parties or by inheritance or gift may not be considered in determining the amount of alimony.
