In California, an unwilling spouse or domestic partner cannot stop the divorce process since there is no paperwork requiring their assent to the divorce. In other states, participation from both spouses may be necessary to finalize the divorce. But if one spouses wishes to divorce and the other spouse does not, this make it almost impossible to obtain a divorce. California courts have the authority to give “default” divorces to couples who disagree on divorce.
